Terms of Use - Pulse

This document is an electronic record in terms of Information Technology Act, 2000 (“Act”), amendments thereof from time to time, rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Act. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Please read these Terms of Use - Pulse (“Terms”) carefully before accessing Pulse (defined below). These Terms govern Your access and use of Pulse (defined below), including the PulsePro (defined below) webpage hosted and managed by PhonePe Limited (Formerly known as ‘PhonePe Private Limited’), having its registered office at Office-2, Floor 5, Wing A, Block A, Salarpuria Softzone, Service Road, Green Glen Layout, Bellandur, Bengaluru, Karnataka - 560103, India (hereinafter referred to as “PhonePe”/ “We”/ “Us”/ “Our”).

All references to “PhonePe”/ “We”/ “Us”/ “Our” under these Terms shall be deemed to mean and include its affiliates, associates, subsidiaries, group companies, their respective officers, directors, employees, representatives, and agents.

Whenever the context requires, “User”/ “You”/ “Your”/ “Yourself” shall refer to the user who uses and/or accesses Pulse subject to these Terms. By proceeding to use Pulse, You are contracting with PhonePe and agree to be bound by these Terms, along with any applicable PhonePe terms and policies issued by PhonePe from time to time (“PhonePe T&Cs”). All capitalised terms used herein but not otherwise defined will have the meanings ascribed to them in the PhonePe T&Cs.

We may amend the Terms at any time. It shall be Your responsibility to review these Terms regularly for updates / changes. Your continued access/ use of Pulse shall mean that You accept and agree to the revision(s), including the additional terms, or modifications etc. If You do not agree with these Terms, then You may choose not to use and/or access Pulse.

1. DEFINITIONS

   1. “Pulse” refers to the online platform/website owned, licensed, managed and/or hosted by PhonePe, which among other things, furnishes insights, reports, trends, and data visualizations pertaining to the digital payment ecosystems, and PhonePe’s proprietary business transactions, Pulse Data, Chatbot AI, etc., made available for public access and informational purposes.
   2. “PulsePro” means the paid service of providing customised data insights and reports by PhonePe to interested Users as set out under the PulsePro webpage.
   3. “Pulse Data” includes all information, datasets, reports, insights, statistics, blogs, trends, visualizations, charts, graphs, aggregated and/or anonymized transaction patterns made available on the Pulse. This includes, but is not limited to, any data or responses generated by the Chatbot AI, any raw data, derived or inferred data/information, downloadable files, and intellectual property derived from PhonePe’s business/ records that have been anonymized/ aggregated, and processed for public disclosure or general use. For clarity, Pulse Data does not include technical, usage-related, or analytics information collected from Users when they access or use Pulse, or any information submitted by Users while interacting with any feature on Pulse, including the Chatbot AI.
   4. “Chatbot AI” refers to the interactive artificial intelligence interface or conversational tool hosted on Pulse designed to assist Users, among other things, in querying and navigating Pulse Data.

2. GENERAL TERMS

   You agree and confirm that:

   1. Pulse is maintained and provided solely for Your informational and educational purposes and is not intended to be used for any commercial or other purposes. It is also not intended to be comprehensive or exhaustive in nature, and PhonePe makes no representations or warranties in relation to Pulse Data.
   2. The Pulse Data constitutes a curated reflection of trends observed within the PhonePe ecosystem and may not encompass the entirety of the digital payments market. PhonePe endeavours to publish updated/ relevant information to the best of its knowledge and ability, but it may not reflect the most updated information at any point of time. Consequently, We do not guarantee the accuracy, reliability, or completeness of the information presented on Pulse, and Pulse Data, any insights or views reflected therein, are subject to change at any time without prior notice.
   3. The Chatbot AI is provided solely as an ancillary conversational tool to assist in the querying and navigation of Pulse Data. You hereby acknowledge and agree that all responses, insights, and data generated by the Chatbot AI are exclusively derived from the Pulse Data and information contained within Pulse. PhonePe explicitly disclaims all responsibility, liability, and warranty whatsoever, arising from Your access, use of, or reliance on the Chatbot AI or its output.
   4. Pulse, including the Chatbot AI, may integrate or utilize tools/products, data feeds (including maps, geographic boundaries, and region naming conventions), APIs, etc. of third parties. Such third-party data, features, or integrations are provided strictly on an "as is", "as available", and “with all faults” basis, by such parties (as per their terms, if any), without any representations, conditions, or warranties of any kind, whether express or implied. PhonePe expressly disclaims all liability and responsibility in this regard, including for accuracy, availability, functionality, or security. Furthermore, You grant PhonePe an unrestricted, irrevocable, perpetual, royalty-free, and worldwide right to collect, aggregate, use and share User-related data, usage metrics, and query histories, including to share it with such third parties for analytical and other purposes (in accordance with PhonePe’s policies).
   5. The geographic boundaries, mapping visualizations, spatial datasets, and region naming conventions utilized on or within Pulse (including Pulse Data and Chatbot AI outputs) rely exclusively on datasets provided by MapmyIndia (C.E. Info Systems Ltd), updated as of September 2025. Such geographic data are provided strictly on an 'as is', and 'as available basis', without any representations, conditions, or warranties of any kind, whether express or implied. PhonePe expressly disclaims all liability and responsibility in connection with, or arising from, any such geographic boundaries, mapping visualizations, spatial datasets, or region naming conventions.
   6. Nothing contained on Pulse, including any Pulse Data, data visualizations, reports, expressed opinions (if any), or any response generated by the Chatbot AI constitutes, or shall be construed as, financial, investment, legal, or any other form of advice, nor shall it be considered or relied on as an official financial disclosure, earnings guidance, investor guidance or any other form of guidance.
   7. The Pulse Data, associated insights, and all other information derived therefrom (including Chatbot AI outputs) represents PhonePe’s data, analysis, data derivatives, and ecosystem-level trends processed via PhonePe’s internal methodologies. Such information reflects Our internal views and interpretations only, and any market observations or trends derived from within the PhonePe ecosystem are strictly indicative in nature and may vary from third-party industry reports. Consequently, You shall not rely on the Pulse Data, including any response generated by the Chatbot AI, in any manner whatsoever as mentioned in these Terms, and any such reliance is strictly at Your own risk. PhonePe accepts no responsibility or liability for the same in any manner whatsoever.
   8. Any usage of the Pulse Data by You including, but not limited to, the downloading or extraction thereof, shall be undertaken strictly at Your sole risk. Pulse Data is processed, derived/ interpreted and ecosystem-level trend data only; it is not a raw representation of PhonePe’s actual business performance, internal metrics, or transaction records. PhonePe expressly disclaims all responsibility and liability, and shall not be held liable for any claims, damages or losses arising from Your use of, or reliance on such data, under any circumstances. You are explicitly advised to exercise independent judgment and to independently verify all information through alternative sources before placing reliance thereon.
   9. You hereby undertake not to utilize any content/information displayed on Pulse, including the Pulse Data, for any illicit, unauthorized, or illegal purposes. Furthermore, You agree not to employ/use such data for any fraudulent purpose or in any manner constituting a violation of applicable laws, regulations, PhonePe’s internal policies, or PhonePe T&Cs.
   10. PhonePe shall be under no obligation, in any circumstance whatsoever, to substantiate, explain, or provide the underlying reasoning and background for the Pulse Data. Furthermore, You acknowledge and agree that PhonePe is not required to disclose any specific calculation methods, computation formulas, data processing techniques, or proprietary algorithms employed to generate the insights, trends, or reports available on the Pulse, or Pulse Data. All such methodologies constitute the exclusive trade secrets and intellectual property of PhonePe.
   11. PhonePe accepts no responsibility or liability in relation to the accuracy, completeness, or usefulness of the Pulse Data for any specific purpose.
   12. The content on the PulsePro webpage is only indicative of the PulsePro services. Any User interested in exploring the PulsePro services, may fill up their details in the form provided on the PulsePro webpage so that the PulsePro sales team can contact them. The PulsePro sales team may subsequently share a sample report (“Sample Report”) for their reference.
   13. By submitting the form on the PulsePro webpage, the User expressly authorizes PhonePe, its group entities including their agents and business partners to:
       1. contact the User via calls, messages, emails, or any other medium to discuss or provide information regarding PulsePro products, services, and offerings; and
       2. send communications including product updates, promotional material, feature announcements, and related informational content.
   14. The User acknowledges that regulations related to unsolicited communication under the ‘National Do Not Call Registry’ of Telecom Regulatory Authority of India will not apply to such communications. The User may choose to unsubscribe from receiving any such communications by writing to [email protected].
   15. The Sample Report is for illustrative purposes only. The User acknowledges and agrees that such Sample Report: (a) contains purely fictitious data and do not reflect any actual, live, or real-time data; (b) is merely indicative of the general format and structure of the deliverables that may be provided under PulsePro; and (c) it is a report that has not been customized, tailored, or configured for any specific user, use case, or industry.
   16. The User agrees and understands that PulsePro is a separate paid service whose features are only illustrated on the PulsePro webpage, and any interested User will be required to enter into a separate commercial agreement (in writing) with PhonePe to receive the PulsePro services.

3. INTELLECTUAL PROPERTY RIGHTS

   1. Pulse may contain Chatbot AI features, trademarks, service marks, names, titles, logos, images, designs, copyrights, and other proprietary materials and information (including, without limitation, any information, data, reports and Pulse Data) that is owned, registered, licensed and/or used by PhonePe (“PhonePe’s IP”) or by third parties (“Third Party IP”). You acknowledge and agree that PhonePe or the respective third party, as the case may be, are the exclusive owners of PhonePe’s IP or Third-Party IP, respectively, and any unauthorized use of such intellectual property is strictly prohibited.
   2. Nothing contained on Pulse, within the Pulse Data, or generated by the Chatbot AI, should be construed as granting, by implication, estoppel, or otherwise, any right, interest, license, or title to any of PhonePe’s IP and/or Third-Party IP. Further, the domain name on which Pulse is hosted is the sole property of PhonePe, and You shall not use, register, or otherwise adopt a similar name or domain in any manner whatsoever.
   3. Subject to Your strict compliance with these Terms and PhonePe T&Cs, PhonePe grants You a limited, non-exclusive, non-transferable, and revocable license to access and use the Pulse Data solely for Your education, non-commercial, and informational purposes.
   4. Any unauthorized utilization or modification of PhonePe’s IP or Third-Party’s IP, or the unauthorized use of such materials on any other platform or networked computer environment shall constitute a breach of these Terms and a violation of proprietary rights and applicable intellectual property statutes. All material on the Pulse is provided solely for Your educational, non-commercial, and informational use, and any other use is strictly prohibited.
   5. You shall ensure the following while sharing, publishing, displaying, transmitting or otherwise making available Pulse Data on any third-party platform, website, application, social media or other like tool:
      1. You shall not modify, crop, edit, alter, manipulate, reproduce, create derivative work from or otherwise tamper with any Pulse Data whether in part or in whole.
      2. You shall not remove, obscure or tamper with any watermark, logo, tradename, copyright, source link, disclaimer, proprietary marking or any other identifier of PhonePe affixed to or forming part of any Pulse Data.
      3. You shall reproduce the text quotes, statements or other written content of Pulse on ‘as is’ basis and shall not modify, paraphrase, selectively extract or present such content in a manner that alters its original meaning or context.
      4. You shall not use, display, publish, reproduce or distribute Pulse Data for any commercial purpose including monetization, promotion, advertising, marketing or other direct or indirect business activity without PhonePe’s prior written consent.
      5. You shall not publish or share Pulse Data on any platform in a manner that suggests, implies or could be reasonably constructed as indicating that PhonePe sponsors, endorses, approves of, is affiliated with, or is associated with any person, entity, product, service, opinion, cause, advertisement or activity unless expressly authorized by PhonePe.
      6. You shall not use, publish or share Pulse Data in conjunction with or alongside any defamatory, obscene, illegal, politically sensitive, misleading, infringing or other objectionable content or material that may reasonably harm the reputation or goodwill of PhonePe.
      7. PhonePe shall at its sole discretion require You to remove or cease publication or use any Pulse Data that it reasonably considers to be in violation of these Terms. You shall comply with such request and remove the relevant content within twenty-four (24) hours from receipt of notice (emails shall suffice). Failure to do so shall constitute material breach of these Terms, without prejudice to any rights or remedies available to PhonePe under applicable law.
      8. You shall indemnify and hold harmless PhonePe against any third-party claims, losses, liabilities, damages, costs and expenses arising from misuse, misrepresentation or unauthorised sharing of Pulse Data on social media or any other platform.

4. ADDITIONAL INFORMATION/ DATA RELATED TERMS

   1. When You access Pulse, PhonePe may automatically collect certain information/details, such as device identifier details, internet bandwidth, mobile device model, browser plug-ins, and cookies or similar technologies that may identify Your browser, plug-ins, time spent, IP address, location, etc.
   2. By accessing, browsing, or utilizing the Pulse, You hereby grant Your express consent to PhonePe for the collection, processing, and use of Your information in strict accordance with these Terms and applicable laws. Where required under applicable law, PhonePe may seek Your consent for specific processing activities, including through appropriate notices, cookie banners, consent tools, or other legally compliant mechanisms.
   3. PhonePe may use data collection devices such as cookies, web beacons, or similar tracking technologies/ tools to optimize platform responsiveness and analyse user trends, and for purposes as provided in these Terms. These cookies or similar technology do not contain any of Your personal information. PhonePe may provide certain features on Pulse that are only available through the use of a “cookie” or similar technologies. Most cookies are “session cookies,” meaning that they are automatically deleted from Your device hard-drive/storage at the end of a session. You are always free to decline/delete our cookies or similar technologies if Your browser/device permits, although in that case You may not be able to use certain features on Pulse. Additionally, You may encounter “cookies” or other similar technologies on certain pages of Pulse that are placed by third parties. You acknowledge that PhonePe does not control the use of cookies by third parties, and We accept no responsibility or liability for them in any manner whatsoever.
   4. Where the User provides any personal data by submitting the form on the PulsePro webpage, the User consents to processing of such data by PhonePe for the purposes of enabling the PulsePro sales team to contact the User for discussions on the PulsePro offerings and sending communications to the User including product updates, promotional material, feature announcements, and related content. The collection, storage and usage of such personal data will be governed by the Privacy Policy.
   5. PhonePe may process Your information to deliver requested pages, retain user preferences and access history, identify trending content, analyse traffic, diagnose and debug system or other failures, and tailor Pulse to Your interests to enhance Pulse quality, functionality, and user experience. You understand that We are processing Your information with Your consent as per these Terms, which consent is automatically granted by You when you access/use Pulse.
   6. To the extent applicable, PhonePe shall store/ retain Your information in accordance with applicable laws and for a period no longer than it is required for the purpose for which it was collected. However, PhonePe may retain Your Information if PhonePe believes it is required by law, such as for any legal/regulatory action or proceeding, or receipt of any legal and/or regulatory direction to that effect, or for other legitimate purposes.
   7. Pulse may include links to other websites or applications when You visit Pulse. Such websites or applications are governed by their respective policies, which are beyond our control. Once You leave Pulse or PhonePe’s servers (You can understand when You are leaving PhonePe’s servers by checking the URL in the location bar on Your browser or on the m-site You are redirected to), use of any Information including personal information that You may provide on these websites or applications is governed by the terms and conditions (including the privacy policy) of the operator of the application/website that You are visiting. That terms and conditions may differ from PhonePe’s Terms and You are requested to review those terms and conditions including their policies or seek access to their policies from the domain owner before proceeding to use those applications or websites. We do not accept any responsibility or liability for usage of Your information by these third parties or their policies.
   8. You agree that if PhonePe is required under applicable law(s), or in any judicial, administrative, or government proceeding/order/ notices issued by law enforcement agencies, or where required by any regulatory authority, to disclose Your Information, PhonePe may disclose such information, to the extent it is required to do so.
   9. In case You have any questions or concerns regarding the processing of Your information, You may write to PhonePe using this link https://support.phonepe.com. We are committed to answer Your questions within a reasonable time period.

5. LIABILITY DISCLAIMER

   1. Pulse (including the Chatbot AI feature) and all the Pulse Data are provided on an "as is", "as available" and “with all faults” basis, without any representations, conditions, or warranties of any kind, whether express or implied. To the fullest extent permissible under applicable law, PhonePe disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PhonePe does not warrant that Pulse, including the Chatbot AI, will operate in an uninterrupted, timely, secure, error-free manner, or free of viruses or other harmful components. Further We do not authorise anyone to make any warranty on Our behalf, and You should not rely on any such statement.
   2. The inclusion of any third-party links, references, or data points on Pulse does not imply an endorsement or validation by PhonePe of such third parties or their products/services. PhonePe does not take responsibility for the content or practices of any third-party websites that may be linked to or from Pulse.
   3. You acknowledge that the Pulse Data may contain information that is derived from aggregated sets of information available with PhonePe. You agree not to attempt to tamper/ modify/ manipulate them in any manner including to de-anonymize, de-compile, or use any automated tools to extract underlying information from the Pulse Data. Furthermore, You agree not to combine, correlate, or cross-reference the Pulse Data with any external datasets, third-party information, or publicly available records, or utilise the Pulse Data for any purpose other than as permitted under these PhonePe T&Cs. PhonePe disclaims any liability arising from Your unauthorized attempts to handle/ manipulate the data.
   4. PhonePe reserves the right to modify, suspend, change, update or remove/ restrict access to, or permanently discontinue Pulse (including the Pulse Data, Chatbot AI, PulsePro webpage and other features), at any time, for maintenance, updates, or for any other reason as We may deem fit, without prior notice. The content/ Pulse Data may contain inaccuracies or errors, and PhonePe shall not be liable for the same, including for any modifications, interruptions, or the temporary or permanent unavailability of Pulse (including Chatbot AI or PulsePro webpage).
   5. You agree that PhonePe shall not be held liable for any inability to access or use Pulse (including Chatbot AI and PulsePro webpage) resulting from factors beyond its reasonable control. This includes, but is not limited to, scheduled system maintenance, telecommunications failures, website upgrades, hacking, or regulatory directions. Furthermore, PhonePe is not responsible for disruptions caused by force majeure events which are beyond Our reasonable control, such as natural disasters, electricity blackouts, war, or terrorist attacks.
   6. In no event will PhonePe be liable for any direct, indirect, consequential, incidental, special, or punitive damages, including without limitation, damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data, or loss of other economic interests, whether in contract, negligence, tort, or otherwise, arising out of or in connection with these Terms, including access of Pulse and/or use of Pulse Data (including Chatbot AI or PulsePro webpage), even if PhonePe has been advised of the possibility of such damages.
   7. In the event of a dispute between You and any third party arising from or in connection with the use of the Pulse (including Chatbot AI) or Pulse Data, You hereby irrevocably release PhonePe, including its affiliates, officers, directors, agents, service providers, and employees, from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

6. OTHER TERMS

   1. You agree to indemnify and hold PhonePe, its affiliates, employees, directors, officers, agents and representatives, harmless, from any and all losses, damages, actions, claims and liabilities (including legal costs) which may arise in relation to these Terms.
   2. In the event of a breach or threatened breach of these Terms, You acknowledge that monetary damages may not be an adequate remedy. Therefore, PhonePe, without waiving any other rights or remedies available under law or equity, shall be entitled to seek injunctive or equitable relief to restrain such breach or to enforce the provisions of these Terms.
   3. PhonePe shall have the right to assign these Term(s) (including all Our rights, obligations and duties in these Terms) or any part thereof to any of our affiliates and to any successor in interest. You may not assign, in whole or part, of these Terms to any person or entity without Our prior written consent, which may be withheld at our sole discretion.
   4. Any failure by PhonePe to enforce any provision of these Terms shall not be construed as a waiver of such provision and shall in no way affect the right of PhonePe thereafter to enforce such provision.
   5. These Terms shall be governed by the laws of India, without respect to its conflict of laws principles. Any claim or dispute between You and PhonePe that arises in whole or in part from in relation to these Terms shall be decided exclusively by a court of competent jurisdiction located in Bangalore.
   6. In the event that any provision of these Terms is declared by any judicial or other competent authority to be void, illegal or otherwise unenforceable, the provision shall, to the extent required, be deemed to be deleted and shall be modified to the extent necessary to render it valid and enforceable under the Applicable Law(s), and the remaining provisions shall remain valid and enforceable.
   7. In case of any conflict between these Terms and PhonePe T&Cs, these Terms shall prevail to the extent of the conflict.
